    1. Description and extent of data processing

      2. Every time our website is accessed, our system automatically records data and information from the computer system of the accessing computer. The following data are thereby collected:

      (1) information on the browser type and version used
      (2) user’s operating system
      (3) user’s Internet service provider
      (4) user’s IP address
      (5) date and time of access
      (6) websites from which the user’s system gains access to our website
      (7) websites accessed from user’s system via our website

      The data are stored in the log files of our system. This data is not stored together with other personal data of the user.

    2. Legal basis for data processing

      3. The legal basis for the temporary storage of data and log files is provided by Article 6, paragraph 1 (f) of the EU General Data Protection Regulation (GDPR).

    3. Purpose of the data processing

      4. The temporary storage of the IP address by the system is necessary to enable the website to be delivered to the user's computer. For this purpose, the user's IP address must remain stored for the duration of the session. The storage in log files is done to ensure the functionality of the website. In addition, the data serves us to optimise the website and to ensure the security of our information technology systems. The data is not evaluated for marketing purposes. These purposes also include our legitimate interest in data processing in accordance with Art. 6 para. 1 lit. f GDPR.

    4. Storage duration

      5. The data will be deleted as soon as they are no longer necessary for the purpose for which they were collected. In the case of the collection of data for the provision of the website, this is the case when the respective session is ended. In the case of data stored in log files, this is the case after seven days at the latest. Storage beyond this period is possible. In this case, the IP addresses of the users are deleted or alienated so that an assignment of the referring client is no longer possible.

    1. Extent of the processing of personal data

This website uses the "Google Analytics" service, which is offered by Google Ireland Limited https://www.google.de/intl/de/about/ (Gordon House, Barrow Street, Dublin 4, Ireland; hereinafter referred to as "Google"), to analyse the use of the website by users. The service uses "cookies" - text files which are stored on your end device. The information collected by the cookies is usually sent to a Google server in the USA and stored there. If individual pages of our website are called up, the following data is stored:

      (1) A fraction of the IP address of the user's calling system
      (2) The website accessed
      (3) The website from which the user has been directed to the accessed website
      (4) The sub-pages that are called up from the called up website
      (5) The time spent on the website
      (6) The frequency of accessing the website

      The data will not be passed on to third parties.

      On this website IP-anonymization is used. The IP address of users is shortened within the member states of the EU and the European Economic Area. Due to this shortening, the personal reference of your IP address is no longer necessary. Within the framework of the agreement on commissioned data, which the website operators have concluded with Google, the latter uses the information collected to create an evaluation of website use and website activity and provides services associated with Internet use.

      4. The processing of the personal data of users enables us to analyse the use of our website. This helps us to constantly improve user-friendliness. These purposes also include our legitimate interest in processing the data in accordance with Art. 6 Para. 1 lit. f GDPR. By anonymizing the IP address, the interest of the users in their protection of personal data is sufficiently taken into account.

    5. Possibility of objection and removal

      6. Cookies are stored on the user's computer. Therefore, you as a user have full control over the use of cookies. By changing the settings in your Internet browser, you can deactivate or restrict the transmission of cookies. Cookies already stored can be deleted at any time. This can also be done automatically. If cookies for our website are deactivated, it may not be possible to use all the functions of the website to their full extent. Furthermore, you can use a browser plug-in to prevent the information collected by cookies (including your IP address) from being sent to Google and used by Google.   6. Contact form
    1. Description and extent of data processing

      2. On our website there is a contact form which can be used for electronic contact. If a user takes advantage of this possibility, the data entered in the input mask is transmitted to us and stored. These data are: Your name, your e-mail address and your message, and optionally your telephone number.

      At the time the message is sent, the following data is also stored: The IP address of the user and date and time of registration.

      For the processing of the data, your consent will be obtained during the sending process. In this context, the data will not be passed on to third parties. The data will be used exclusively for processing the conversation.

      3. The legal basis for the processing of the data is Art. 6 para. 1 letter a GDPR if the user has given his consent.

    3. Purpose of data processing

      4. The processing of the personal data from the input mask serves us only for the purpose of making contact. The other personal data processed during the sending process serves to prevent misuse of the contact form and to ensure the security of our information technology systems.

    4. Storage duration

      5. The data will be deleted as soon as they are no longer necessary for the purpose for which they were collected. For the personal data from the input mask of the contact form and those sent by e-mail, this is the case when the respective conversation with the user has ended. The conversation is finished when it can be concluded from the circumstances that the matter in question has been finally clarified.
      The additional personal data collected during the sending process will be deleted after a period of twenty-one days at the latest.

    5. Possibility of objection and removal

      6. The user has the possibility to revoke his consent to the processing of personal data at any time. In such a case the conversation cannot be continued.

      The revocation is to be sent to our data protection officer by post at the above-mentioned address of the person responsible with the addition "data protection officer" or by e-mail at datenschutzbeauftragter@edev-ag.ch.

      In this case, all personal data stored in the course of the contact will be deleted.

  7. Age and identity verification with „CommuniCheck“
    1. 1. Description and information processing
      2. For payment and order processing of age restricted content and service we control in advance if the user has reached the legal minimum age for the relevant content or service. Equally necessary for technical processing of billings and payoffs is an identity verification via „CommuniPay“.
      For this purpose we use „CommuniCheck“, which offers several methods for age and identity verification, in the following are external service providers listed:

      • Yoti (https://www.yoti.com/)

      Within the framework of age and identity verification, depending on the chosen method, the following data is collected and processed, if necessary transmitted to the external service provider mentioned above:

      • inventory data (e.g. names, addresses)
      • birthdate
      • face pictures or face video recordings
      • pictures or video recordings of an identity document

      3. Data handling takes place

      • For the performance of the contract to which you are a party, or for the performance of pre-contractual measures on the legal basis of Art. 6 para. 1 lit. b GDPR;
      • For the fulfillment of a legal obligation to which we are subject pursuant to Art. 6 (1) lit. c GDPR in conjunction with Section 10 Jugendschutzgesetz (German Youth Protection Act), as we are obligated to age verification, and commercial, trade or tax law, to the extent that we are obligated to record and retain data.

    3. 3. Duration of data storage
      4. The duration of storage of personal data collection is depended on the occasion the data were used for:

      • Personal data collected will be generally stored for the length of the valid contract, and after that maximum 10 years due to the statute of limitation.
      • Personal data storage to which we are legally obliged for reasons of non-contractual or fraudulent behavior will be stored generally 5 to 7 years.
      • Personal data, which are not used for the purpose of the contractual relationship, or for which are no legally binding obligations are only stored for the duration necessary of the occasion of data handling.
  8. Rights of data subject

    9. You have the right:

    • pursuant to Article 15 GDPR, to request information on your personal data processed by us. In particular, you may request information on the processing purposes, the category of the personal data, the categories of recipients to whom your data were or are disclosed, the period for which the personal data will be stored, the existence of a right to rectification, erasure, restriction of processing or objection, the existence of a right to lodge a complaint, the source of your data if these have not been collected from us, and on the existence of automated decision-making including profiling and if applicable meaningful information on the details thereof;
    • pursuant to Article 16 GDPR, to request without undue delay the rectification of inaccurate personal data or the completion of your personal data stored with us;
    • pursuant to Article 17 GDPR, to request the erasure of your personal data stored with us unless the processing is necessary for compliance with a legal obligation, for reasons of public interest or for the establishment, exercise or defence of legal claims;
    • pursuant to Article 18 GDPR, to request the restriction of your personal data where the accuracy of the data is contested by you, the processing is unlawful but you oppose the erasure of such data and we no longer need the data but you require the same for the establishment, exercise or defence of legal claims, or you have objected to processing pursuant to Article 21 GDPR;
    • pursuant to Article 20 GDPR, to receive your personal data which you have provided to us in a structured, commonly used and machine-readable format or to request transmission of such data to another controller;
    • pursuant to Article 7(3) GDPR, to withdraw from us the consent given by you at any time. The consequence of this is that we will no longer be allowed to continue the data processing that was based on such consent for the future, and
    • pursuant to Article 77 GDPR, to lodge a complaint with a supervisory authority. For this purpose you may as a rule turn to the supervisory authority of your habitual residence or of your place of work or of our corporate seat.
  9. Right of objection

    10. You may object to the processing of data for legitimate interests pursuant to Article 6(1)(f) GDPR if reasons arise from your particular situation arguing against such data processing. Such objection must be directed to our Data Protection Officer by post at the above address of the controller adding the suffix “Data Protection Officer” or by e-mail to datenschutzbeauftragter@edev-ag.ch

  10. Amendment of this Privacy Policy

    11. Due to the further development of our website and offers above or due to changed legal or official requirements it may become necessary to change this privacy policy. The current privacy policy or earlier valid privacy policies can be accessed and printed out at any time on this website.
